Terms of Service

1. Definitions

"Service"
The deploybase static site hosting platform, including the web application, API, build system, and CDN delivery.
"We", "us", "our"
TwanIT, trading as deploybase, KVK 71667415, Weeshuisstraat 47, 8011 TZ Zwolle, Netherlands.
"You", "your", "Customer"
The person or organization that creates an account and uses the Service.
"Content"
Any files, code, assets, or data you upload to or deploy through the Service.
"Account"
Your registered account on the Service, including all projects and deployments associated with it.

2. The service

deploybase provides static site hosting with build automation, CDN delivery, custom domains, and deployment management. The Service is designed for hosting static websites and single-page applications.

We reserve the right to modify, improve, or discontinue features of the Service at any time. For material changes that affect your use, we will provide at least 30 days notice.

3. Accounts

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must promptly notify us of any unauthorized use of your account.
  • One person or legal entity per account. Sharing account credentials is not permitted.
  • You must be at least 16 years old to use the Service.

4. Acceptable use

You agree not to use the Service to host, distribute, or facilitate:

  • Malware, phishing pages, or other malicious software
  • Content that infringes on intellectual property rights of others
  • Content that is illegal under Dutch or EU law
  • Spam, unsolicited bulk messaging, or deceptive practices
  • Cryptocurrency mining or other resource-abusive activities
  • Content that promotes violence, discrimination, or hate speech

We may suspend or terminate your account if you violate this policy. Where possible, we will notify you and provide an opportunity to resolve the issue before suspension.

5. Payment

Billing

Paid plans are billed monthly or annually in advance. All prices are listed in euros and include VAT where applicable. For business customers in the EU (with a valid VAT ID in another EU country), VAT reverse charge applies.

Price changes

We may adjust pricing with at least 30 days written notice. Price changes take effect at the start of the next billing cycle. If you do not agree with a price change, you may cancel before it takes effect.

Refunds

As a B2B service, there is no statutory cooling-off period. We do not offer refunds for partial billing periods. If you experience a significant service disruption, contact us to discuss credit.

Overdue payments

If a payment fails, we will attempt to collect again and notify you by email. After 14 days of non-payment, we may suspend your account. Deployed sites will remain accessible for an additional 14 days before being taken offline.

6. Service availability

We aim to provide high availability but do not guarantee specific uptime percentages at this time. The Service is provided on a "best effort" basis.

We may perform maintenance that temporarily affects availability. Where possible, we will schedule maintenance during low-traffic hours and notify you in advance.

We are not liable for downtime caused by factors outside our control, including but not limited to: upstream provider outages, DNS propagation, or internet connectivity issues.

7. Intellectual property

Your content

You retain all rights to the Content you upload and deploy through the Service. We do not claim ownership of your Content. By using the Service, you grant us a limited license to host, serve, cache, and distribute your Content as necessary to provide the Service.

Our platform

The deploybase platform, including its code, design, and branding, is owned by TwanIT. You may not copy, modify, or reverse-engineer any part of the platform.

8. Data and privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.

All data is stored and processed within the European Union. We comply with the General Data Protection Regulation (GDPR / AVG). If you process personal data through deploybase, our Data Processing Agreement applies.

9. Limitation of liability

To the maximum extent permitted by Dutch law:

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
  • We are not liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, data, or business opportunities.
  • Our total aggregate liability for any claim arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim.
  • We are not liable for any loss or damage resulting from Content you host on the Service, or from third-party access to your deployments.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages (including legal fees) arising from:

  • Content you host on or distribute through the Service
  • Your violation of these Terms or applicable law
  • Your violation of any third-party rights

11. Termination

By you

You may cancel your account at any time through your account settings or by contacting us. Your access will continue until the end of your current billing period.

By us

We may suspend or terminate your account for violation of these Terms, non-payment, or if required by law. We will provide reasonable notice where possible.

After termination

Upon termination, you have 30 days to export your Content. After this period, we will delete your Content and personal data in accordance with our Privacy Policy. Billing data is retained for 7 years as required by Dutch tax law.

12. Force majeure

We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to: natural disasters, war, terrorism, pandemics, government actions, power failures, internet outages, or third-party service failures.

13. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will notify you at least 30 days in advance by email. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.

If you do not agree with the changes, you may cancel your account before they take effect.

14. Governing law

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or in connection with these Terms shall be submitted to the competent court in Zwolle, Netherlands.
